Samsung Loses Appeal to Arbitrate Smart TV Surveillance Claims – Bloomberg Law


Samsung Electronics America Inc. lost its bid to arbitrate a suit claiming it illegally monitored the Internet-streaming usage of Smart TV owners, when an appellate court ruled Tuesday the company must face the proposed class action in federal court.

Samsung waived its right to compel arbitration of the plaintiffs’ claims by pursuing dismissal of the lawsuit on the merits and carrying out the litigation in a manner inconsistent with an intent to arbitrate, Judge Julio M. Fuentes of the US Court of Appeals for the Third Circuit said.
